These Terms and Conditions apply to all users of this site, including, but not limited to, users who browse the site, are sellers, customers, merchants, and/or content contributors.

By accessing or using any part of this site, you agree to be bound by these Terms and Conditions. If you do not agree to all of the terms and conditions of this agreement, then you must not access the website or use the services offered on it. If these Terms and Conditions of Sale and Use are considered an offer, acceptance is expressly limited to these Terms and Conditions of Sale and Use.

The www.radermecker.com e-commerce site is hosted on Shopify Inc. They provide us with the e-commerce platform that allows us to sell our products and services to you.

The present conditions aim at defining the terms and conditions of distance selling between RADERMECKER SCRL and the Buyer, from the order to the payment and the delivery. They regulate all the steps necessary for the placing of the order and ensure the follow-up of this order between the contracting parties.

Any order implies irrevocable acceptance of the general conditions of sale. These general terms and conditions of sale may be subject to change, the conditions applicable are those in force on www.radermecker.com on the date the Buyer places his order.

By accepting these terms and conditions of sale and use, you represent that you have reached the age of majority in your country, state or province of residence, and that you have given us your consent to allow any minor in your care to use this website.

The fact that the customer was unable to read these conditions in his or her native language shall not affect their validity.

2 - The products :

We have done our best to display as clearly as possible the descriptions, colours and images of our products that appear on our shop. We cannot guarantee that your computer screen will display the colours accurately. The photographs illustrating our products are not contractually binding. RADERMECKER SCRL cannot be held responsible for any errors or omissions.

Use of our products for any illegal or unauthorised purpose is prohibited, nor shall you, in using the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

Any order implies acceptance of the prices and descriptions of the products available for sale.

We offer you the sale of samples of our leathers in order to appreciate the colour, the aspect, the softness and the quality of our leathers, and so that you can make the best choice and avoid returns of order.

We reserve the right, but are not obligated, to limit sales of our products or services to any person, and in any geographic area or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any product or service we offer. All product descriptions and product prices are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue offering any product at any time. Any offer of service or product made on this site is void where prohibited by law.

We do not warrant that the quality of any products, services, information, or other merchandise obtained or purchased by you will meet your expectations, or that any errors in the Service will be corrected.

Our leathers :

Leather is of course a natural material, and so can have random elements:

  • Dimensional variations in width and length
  • Imperfections (scars, wrinkles, etc.) can be present anywhere in the skin area

Equestrian equipment :

Most of the equestrian equipment is made from our own leather or is purchased within the European Union, thus complying with European standards.

Accessories :

All of our accessories are purchased in Europe, and thus comply with European standards.

3 - Availability of products

Our products offered for sale on www.radermecker.com are stored on our premises. The availability of the products sold is indicated on each product sheet. Due to the updating of our stocks, errors in stock information are possible.

In the event that the product(s) ordered is (are) not available, RADERMECKER SCRL will inform the customer of this unavailability as soon as possible either by email or by telephone (depending on the information provided by the customer). RADERMECKER SCRL undertakes to partially deliver any other ordered and available products. By mutual agreement with the customer, RADERMECKER SCRL undertakes either to deliver the unavailable product as soon as it is restocked (the time limit will be communicated to the customer in advance), or to proceed with a refund.

4 - Awards

The prices as well as the transport costs of our products are expressed in EURO, VAT included. The VAT applied is the VAT of the country of the customer's billing address. All orders are invoiced and payable in Euros only. The amount of the order is calculated according to the prices in force at the time the order is accepted, and is payable in full and in one go when the order is placed. All orders are considered acceptance of the prices and descriptions of the products available for sale.

The prices indicated on the product sheets do not include transport costs. Transport costs include: transport, handling, packaging and commissioning costs.

Prices for our products are subject to change without notice. We reserve the right to correct any typographical errors or pricing omissions within reason.

5 - How to order

The automatic recording systems are considered as proof of the nature, content and date of the order.

We reserve the right to accept or refuse an order. We can only accept an order while stocks last.

The customer has the possibility to place an order remotely from our website www.radermecker.com. The order can only be registered if the customer has clearly identified himself by entering his email address and password (access to his customer account). If the customer does not have a customer account, they must create one in order to place an order.

This customer account allows the customer to choose a password which, in the case of subsequent orders, will save him/her from having to fill in the forms prior to placing the order again. A customer who has already created an account is recognised as a RADERMECKER SCRL customer. The password used by the customer of RADERMECKER SCRL is strictly confidential and personal. Under no circumstances shall it be disclosed or communicated to anyone. In the event that the RADERMECKER SCRL customer should lose or forget his or her password, a link for requesting a password reset is available in the customer account. The password will then be reset and a new password will automatically replace the old one.

Once the selected item(s) have been added to the basket, and after having checked the specifics of the order (quantity, size, price, etc.), the customer validates the choice of the selected product(s) by clicking "finalise order". If the customer benefits from a special offer, he/she must first enter a code that has been allocated to him/her in the field provided for this purpose. The customer will then have to check or enter the data for the delivery, choose the delivery methods, then the payment methods.

Acceptance of the general terms and conditions of sale and our privacy policy is mandatory to validate and finalise the order.

Once the buyer has validated his/her payment, an order confirmation will be sent by email to the address indicated at the time of the order. This confirmation will include all the elements of the contract between the buyer and the seller.

6 - Terms of payment

Payment shall be made in EURO. RADERMECKER SCRL accepts no responsibility for any additional bank charges.

All orders shall be paid for in cash at the time of placing the order. RADERMECKER SCRL does not grant any discount for early payment. Payment shall be made in Euros.

The different methods of payment accepted for orders on the site www.radermecker.com are :

  • By credit card via Shopify payments
  • By Paypal

Our site has an SSL certificate (https://) guaranteeing the encryption of all data that passes through our website. The encryption is 256 bits.

In addition, payments via SHOPIFY PAYMENTS and PAYPAL are known to be extremely secure.

Payment by credit card is subject to the approval of the financial institution issuing the card. RADERMECKER SCRL declines all responsibility in the event that the financial institution refuses payment for any reason whatsoever.

7 - Delivery & shipping

Deliveries can be made to the following countries: Austria, Belgium, Bulgaria, Czech Republic, Denmark, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Luxembourg, Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain and Sweden.

The products are shipped by our service provider DPD, the delivery time depends on the country of destination.

The products are delivered to the address indicated by the customer at the time of the order and only in the geographical zones that we serve. When the parcel is picked up by our carrier, a tracking link will be sent to the customer at the email address indicated when the order was placed, in order to follow the progress of the delivery of the order. In the event of an error in the details entered by the buyer, the seller cannot be held responsible for any problem encountered in connection with the delivery.

Delivery costs are at the buyer's expense, the amount of which is indicated on the order summary. The amount of the delivery costs are calculated according to the weight of the package and the country of destination. The payment of the order in its entirety constitutes acceptance of the delivery costs and cannot be the subject of a later complaint.

All our products leave our premises in perfect condition. Upon receipt of the parcel(s), the customer must report to the carrier the slightest trace of shock, and if necessary refuse the parcel. Upon receipt of the order, the customer must carefully check the contents of the package. The exchange or reimbursement of any product declared, after the fact, damaged during transport, without any reservation having been made on receipt of the parcel, cannot be taken into account.

Possible delays in delivery do not give the customer the right to cancel the sale, to refuse the goods or to claim damages. In the event of late delivery or loss of the package, and after the customer has informed us of the non-receipt of his order, we will contact the carrier to start an investigation. Every effort will be made by RADERMECKER SCRL to find the package. We do not accept any responsibility for longer delivery times or delivery problems caused by the carrier.

The customer must inform RADERMECKER SCRL of any delivery problems caused by the carrier, and of any claims of delivery error in relation to the information on the order confirmation, by e-mail and at the latest within 24 hours after the actual delivery date to the customer. After this period, any claim will be rejected, and RADERMECKER SCRL will not be liable.

8 - Returns and refunds

From the date of receipt of the order, the customer has a period of 14 clear days to return the article. After this period, the products delivered are deemed to be in conformity and accepted by the customer, and RADERMECKER SCRL reserves the right to refuse the refund.

In order to return an item, the customer must inform RADERMECKER SCRL within the time limit specified via the form provided for this purpose on the website www.radermecker.com or by email. The return of the parcel can only be made after a confirmation by email from RADERMECKER SCRL. The article must be returned to the address indicated in Article 1, and it must be accompanied by a copy of the invoice and the return form provided for this purpose, for optimum management. The cost of the return is entirely at the customer's expense.

Upon receipt of the returned package, the quality department of RADERMECKER SCRL will verify that the item is returned in a condition similar to the original one allowing its remarketing in new condition. Only after this verification, the refund or exchange may be made.

The refund will be made within 14 days after receipt of the goods. The refund will be made according to the method of payment used. The refund will take into account the total amount of the order (including delivery costs). In the case of a partial return, the delivery costs will be reimbursed in proportion to the weight of the returned goods.

9 - Right of withdrawal

According to Article VI. 47 of the Code of Economic Law, the consumer has the right to notify the company that he renounces the purchase, without penalties and without giving any reason, within 14 calendar days from the day following the day on which the consumer or a third party other than the carrier and designated by the consumer takes physical possession of the goods.

Article VI.53 et seq. of the Code of Economic Law concerning exceptions to the right of withdrawal do not apply when you purchase products from RADERMECKER SCRL.

The Consumer who wishes to invoke his right of withdrawal must always communicate it expressly and without any ambiguity, and necessarily in writing. The withdrawal form is available HERE.

The burden of proving that he can rely on his right of withdrawal lies with the Consumer. He shall provide RADERMECKER SCRL with the following information in a clear manner:

  • Mention of the following three dates: date of the order, date of receipt and date on which the right of withdrawal is invoked
  • Name and address of the Consumer
  • Signature of the Consumer

The return of an order shall in all cases be at the expense and risk of the Consumer. RADERMECKER SCRL reserves the right to suspend the refund as long as no proof of return is provided by the Consumer. The Buyer shall be liable for the reduction in value of the goods resulting from the handling thereof, if such handling goes beyond what is necessary to determine their nature, characteristics and functioning. RADERMECKER SCRL shall be entitled to take this decrease in value into account proportionately in the reimbursement. The Consumer shall be deemed to have misused the right of withdrawal if he does not fulfil the above conditions. In this case, the products shall be returned to the Consumer for his own account and risk. RADERMECKER SCRL undertakes to clearly communicate the reasons for the return to the Consumer.

 10 - Cases of force majeure

RADERMECKER SCRL shall not be liable for any loss or damage caused by delay or non-performance of its obligations under these Conditions, if such delay or non-performance is due to circumstances such as strikes, occupation, riots, war, fire or force majeure, or to defects or defaults by suppliers of RADERMECKER SCRL, restrictions imposed by the authorities, the non-issuance of import or export licences, compliance with the law, regulations or orders or any other circumstances or causes whatsoever which would result in a defective performance of these conditions, or any other reason whatsoever beyond the control of RADERMECKER SCRL.

The party affected by such circumstances shall notify the other party within 10 working days of becoming aware of them.

11 - Export restrictions

Products purchased from RADERMECKER SCRL are subject to Belgian export laws and regulations. The Buyer accepts the responsibility and expense of obtaining the necessary permits in connection with the nature of the goods to be exported, their destination or their use.

12 - Warranty

The sale of goods is subject to the Belgian legislation concerning the legal guarantee provided by the law of1 September 2004.

13 - Competent bodies and courts

The sale of goods on www.radermecker.com is subject to Belgian law; any disputes will be dealt with by the Belgian courts.

14 - Complaints and disputes

15 - Handling of complaints

Complaints concerning the performance of the contract and/or the items supplied must be complete, clear and submitted within a reasonable time to RADERMECKER SCRL.

Complaints submitted will be dealt with as soon as possible.

In the event of a dispute, the buyer can seek advice or lodge a complaint with the ECC (European Consumer Centre).

Within the framework of the out-of-court settlement of disputes, the Consumer Mediation Service of the FPS Economy is competent to receive any request for out-of-court settlement of consumer disputes (contact via the following link: http: //www.mediationconsommateur.be/fr).

In the event of a cross-border dispute, you can also use the European Union's Online Dispute Resolution (ODR) platform via the link: http: //ec.europa.eu/odr

16 - Headings and termination

All headings in these Terms are for convenience only and do not form part of these Terms. These headings are not to be used for the interpretation or explanation of these conditions.

If any provision or wording of these terms and conditions is found to be illegal, invalid or unenforceable for any reason, such provision or wording shall remain enforceable to the extent that it is legally enforceable, and the validity, legitimacy and enforceability of the remaining provisions shall not be affected thereby.

17 - Use of electronic means of communication

The sale of products offered on the RADERMECKER SCRL website is carried out by electronic means. You therefore agree that RADERMECKER SCRL may communicate with you by this means. RADERMECKER SCRL is authorised to send you electronic messages and other communications relating to your order via the Internet.

RADERMECKER SCRL is authorised to send messages by other means (e.g. DPD).

To the extent permitted by law, you agree, in the event of a dispute, not to challenge the validity of any order, information, communication or message transmitted electronically between the parties under this Agreement.

18 - Reservation of ownership

The transfer of ownership of the products to the benefit of the buyer will only take place after payment of the full price (and other related costs and/or taxes), regardless of the delivery date of the products concerned.

The transfer of risks, loss and deterioration of the products will be carried out as soon as the products are delivered and therefore as soon as the buyer is in possession of the products.

19 - Cookies

During a visit to the www.radermecker.com e-commerce site, cookies may be automatically stored on the hard disk of the consumer's computer. This data helps us to better adapt the site to the wishes and preferences of visitors. It may also be used to display offers and promotions or to communicate about products/services that may be of interest to the consumer.

Most recent web browsers offer the option to erase cookies from the hard drive, refuse them or display a warning before they are set. You can consult the instructions or help section of your Internet browser for further details. If the consumer allows the use of cookies during a visit to the website, they can be used the next time they log on to the website.

20 - Personal data

With regard to the requirements of the General Data Protection Regulation (GDPR),

The personal information collected for the purposes of distance selling is compulsory, as this information is essential for the processing and delivery of orders and for the preparation of invoices.

This information is strictly confidential and is only intended for use by RADERMECKER SCRL. RADERMECKER SCRL does not market your personal data.

The customer has the right to view your data, to correct errors or to have your data deleted from our database.

The customer undertakes to inform RADERMECKER SCRL in good time of any change in his usual data in order to enable RADERMECKER SCRL to provide a correct service.

The personal data of the customer is of crucial importance to RADERMECKER SCRL. RADERMECKER SCRL therefore makes it a point of honour to ensure that this data is protected to the best of its ability and that the customer's rights are systematically guaranteed when this data is used, in accordance with the applicable rules on privacy and personal data protection.

RADERMECKER SCRL may process all or part of the data: to enable navigation on the website and the management and traceability of the services ordered by the user; to prevent and fight against computer fraud; to improve the navigation of the website; to carry out communication campaigns and possible optional satisfaction surveys; by necessity or for statistical and analysis purposes.

Finally, the customer has the right to lodge a complaint with the supervisory authority for data protection, namely the Belgian Data Protection Authority.
